Council refers revenue bond measure to Finance Committee, Finance Committee cancels all upcoming meetings until September. What do you think that means?

This morning I attended the monthly City of Chico Finance Committee meeting because council has directed the committee to vet a bond measure for “street improvement.” Council member Mark Sorensen made the suggestion in response to councilor Karl Ory’s suggestion that the city put a sales tax increase on the November ballot. 

In her column in the cat box liner known as “Chico News and Review,” editor? Melissa Daugherty suggest the vote “went along party lines,” and the “conservatives” voted down Ory’s suggestion. What a laugh – there aren’t any conservatives on Chico City Council. 

It comes down to common sense – the voters have made it pretty clear they will not support a sales tax increase. More important, local business owners are screaming NO! – Chico retail is already suffering death by a thousand cuts, who needs a sales tax increase?!

Funny this suggestion comes from Chico Chamber of Commerce – until you look at their membership – mostly non-retail!

So Sorensen suggested a bond measure and sent it to the Finance Committee for discussion.

Except there won’t be any discussion of this measure until September, because Administrative Services Director (formerly known as Finance Director) Scott Dowell talked the committee into cancelling the July and August meetings. 

I’ll say for Morgan, he wanted to have the July and August meetings, he said the public would want to be in on the  discussion. But he sat there while Dowell essentially cancelled the meetings. Committee member Randall Stone seemed to go along more willingly with the cancellation. Committee chair Mark Sorensen, who suggested the measure in the first place, was absent because of an “emergency situation” in Biggs, where he yanks down over $100,000/year plus publicly paid benefits as Biggs’ city manager. 

You know how it is, you can’t have your dick in two places at once.

You realize, that means the discussion goes behind closed doors. In fact, while they wouldn’t discuss the bond measure at today’s meeting – they’re not allowed to discuss stuff that’s not on the agenda – Assistant city manager Chris Constantin tried to take it up after the meeting had been adjourned and almost everybody had left the room. Constantin immediately pulled Mayor Sean Morgan aside and started whispering, essentially, what did Morgan want? Morgan started to suggest that Constantin bring forward all possibilities for funding road work in Chico, and Constantin was telling him that he will be working with the public works department to come up with a figure. 

“It will be at least $100 million…” was the last thing I heard Constantin say aloud as I pulled my chair and my notebook up to the table. Constantin lowered his voice to almost inaudible and turned his back to me. I moved closer and asked, “is this a private conversation? Am I allowed to listen? I thought by the way you were whispering you don’t want me to hear what you’re saying?”

At that point Constantin turned to me and assured me it was not a private conversation. But the conversation ended, and Constantin left the table to approach Chamber of Commerce maven Jolene Francis. From what I could overhear, he was asking her how they would switch from a sales tax increase measure to a bond measure. But I was in a hurry to go  back to work, so I let it go.

This is how they run our town behind our backs. I’m pretty certain they would have talked about the bond a lot more today if I hadn’t been there – there was no other member of the public present except for pro-tax cheerleader Stephanie Taber.

I’ll tell you what was also funny – Dowell’s finance report was nothing but KUDOS! Budget right on schedule! Revenues up three percent! $11 million more in cash flow than last year! Sales tax revenues up 6 %! Kinda makes you wonder – why would we need a revenue measure?

But you have to read between the lines. Most of the report was about supplemental allocations and budget transfers – the budget means nothing, they spend money however they want. When they can’t pay salaries in one department they just  steal the money from another department. That’s why there’s no money to fix the streets, and the sewer fund is so flat the city is actually entertaining a hook-up with Paradise – 20 miles east of Chico, in the foothills.

Before he was elected to City Council, Mark Sorensen blogged about all the money the city was stealing out of the sewer fund to pay pensions – you won’t find that blog online anymore, and you won’t get Sorensen to talk about the sewer fund.

Dowell also announced, last year was a record year for parking fines! But he opined, fiscal year 2018/19 won’t bring in as many parking revenues. He said, “I’d like to believe people are becoming cognizant of the laws…”

You know the only place they enforce parking is Downtown? But they still have record parking fines? I was reminded of a trip I took Downtown to deal with PG&E. As I stood in the pee-stinking Downtown PG&E office, I watched a family park their car, put change in the meter and walk into the building. They were setting up PG&E for their college kid. The woman watched as a parking attendant walked up and placed a ticket on their windshield. She expressed disbelief as her husband went out to see what that was about. He approached the attendant, and then he got in his vehicle as the attendant took the ticket off his window. He moved the vehicle slightly, got out, watched the attendant walk away, and came back inside. She had informed him that his vehicle was a few inches out of the parking space, and when he’d protested she’d offered to let him fix it. So he moved his car about an inch, I mean, I couldn’t even see any distance, and she tore up the ticket. He was really angry about it, but afraid to disagree with a woman who could give him a ticket out of spite. 

The parking laws have not changed Downtown, it’s the method of “enforcement” that has changed. The private parking enforcement  company that the city hired is paid based on how many tickets they hand out. That’s incentive. I don’t know how this is legal, but the chief of police in San Luis Opispo had to leave his job because he offered his patrol teams pizza as a reward for tickets.

The problem we have here is a city who knows they are acting illegally but waits for some citizens’ group to pony up money for a lawyer to call them on it. They’re absolutely desperate to get money to pay down the pensions, because most of our council members are pentioneers, or are married to pensioneers.

We will assume that the city will have a bond measure ready for either the November ballot or a special election in an upcoming year. We need to let them know – especially those who are running in November, we could recall anybody who supports this revenue measure. The Reform California people successfully recalled the legislator who put the gas tax – SB 1 – on the legislative agenda. 

We also need to let them know, we can come up with a measure of our own – to dump the Utility Users tax. That’s $7 million a year they tack onto our PG&E and Cal Water bills. They add unknown amounts to our bills with their shake down “franchise fees.”

Why do people ignore a problem until it’s too late to do much about it, then expect to complain? Trash deal has been in the works since 2012 – now people want to bitch about it?

I just got my new 2018 Waste Management bill for three months (32 gallons) of $59.70, up about 55 percent from previous bills of $38.55. I realize there is always a bit of inflation but 55 percent? By chance, did the city hire the negotiator from the Pentagon’s F35 program for the Waste Management contract?

I also read that pot was legal in California in 2018 but our City Council decided that a retail pot store was not appropriate for our fair city. How am I supposed to relieve the anxiety of opening my Waste Management garbage bill? I’m very unhappy with our City Council.

You know how I love to say “I told you so.”   

That’s not really true – it drives me nuts, trying to get people to pay attention to an issue when there’s still time to stop the bulldozers, but they give me that same old tired bullshit – I’m sorry, I have a life! Why don’t you get one Juanita?

But of course, later, they  get to whine and complain about it.

Somebody read one of my old posts on the subject yesterday, from 2014. At that time, Joe Matz of Recology was saying rates would triple, and the city was looking at requiring service for everybody. If you wanted to haul your own trash they wanted to inspect your vehicle, etc, which was tantamount to requiring a hauler’s permit.

When Juanita raised her scrawny little fist and said, “If you require service the city will have to provide a low-income subsidy…” 

To which the consultant answered, “She’s right.”  He smiled at me across the room. It wasn’t the consultant’s fault, he was very truthful about the whole thing.

OOO! The bulldozers had to stop and listen! You’ll notice, service is not required under this deal, and you can still take your trash to the dump without a hauler’s permit. Which means, neighbors/relatives/friends can still share cans to save money.

Just think if there was four more Juanitas.  Or at least four more people who went to these meetings and raised a scrawny little fist?

And here’s what I’ll  tell Geoff – read the Waste Management website – you can opt out of yard waste service and save almost $6 bucks a month. My family, who share service with our tenants, also opted for a smaller bin. Our son has moved away to college and our tenants don’t have much trash either – we realized we didn’t need that 96 gallon bin anymore.

Once I made those changes in our account, the rate is still about $5 more per month. No, I’m not happy about that. But I wish people who complain would educate themselves – the real problem at this point is the city wants to use the new revenue to pay down their pension deficit instead of fixing the streets like they said they would. That’s where we need to hit them, and hard.

In fact, public works director Brendon Ottoboni says the road/streets fund is tapped, and they are almost 10 years behind on necessary projects. When developer Bill Webb asked at a recent public meeting how a person could get their street on the projects list, Ottoboni again said there’s no money for fixing any more streets.

Really Randy? On Wednesday I have a Recology truck on my street, servicing the “commercial enterprise” known as the Evangelical Free Church. On Thursday my bins  are picked up by Waste Management. On Friday Waste Management picks up the bins on the street that intersects my street. So, I get a minimum of seven trucks a week running up and down the street in front of my house.

But here’s another funny fact – my street is not considered a  “feeder” by the city of Chico, because there is no new subdivision on my street, so my street will never be on the “projects” list – ask Ottoboni about that.

Letters to the editor of a newspaper that reaches less than a third of local residents isn’t going to cut it. A few months ago council member Ann Schwab suggested a complaint line for garbage customers so they wouldn’t have to write to the mayor. Why not write to the mayor?  He approved this deal too.

Pensions before streets – business as usual in Chico California

The Finance Committee meeting I attended Wednesday (11/29/17) also included a discussion of “street urbanization fees.” The city of Chico supposedly requires developers to provide or pay for new curbs and gutters in existing neighborhoods whenever they build a new subdivision.

About 10 years ago the city approved a new subdivision in my neighborhood – in a former neighbor’s back yard – and despite the protests of our neighbors, gave the builder “variances” to just about everything in the city code. The result was seven houses where there was really only room for three or four. There is a constant turnover of residents and they all  bring lots of cars. A few days ago we noticed a giant moving van out on the street in front of the subdivision – there is absolutely no place to park a vehicle like that on their own street. In fact, there is no place for garbage trucks to turn around, they have to back out.

This was before the city even discussed “variable rates” for developers – see how they do what they want.

But no improvements were made on our main street, which has become a “feeder” or “through” street for all these little subdivisions that sprung up in Grandma’s back yard over the course of several building booms and busts.

Builder Chris Giampoli, who does a lot of CHIP housing, does not feel he should have to make those improvements when he shoves five CHIP houses into an existing neighborhood. Well, we’re not talking about the entire street, we’re just talking about curbing and guttering the feeder street where his new street breaks in. Giampoli opined that if the feeder is already crapped out, that’s from existing residents, and developers shouldn’t have to pay for bringing the street up to “current standards.”

What Giampoli and his friend Dan Gonzalez are suggesting through their “variable rates” ploy, is that existing residents subsidize their for-profit development business. Giampoli was one of five developers, along with Tom DiGiovanni, who got the permits for Gonzalez’ project at Meriam Park,  named in a lawsuit threatened by CalTrans, over subdivisions being built without fees being collected for the improvements recently made to highways 99 and 32.  According to Mark Sorensen, those developers have never paid fees toward those highway widenings, which their projects necessitated.  So beat it Chris, you been getting a free ride for too long there buddy. You couldn’t survive in the free market, like your dad did, cause you cut corners and build subsidized crap. Dan Gonzalez isn’t going to be able to sell Meriam Park without government hand-outs, and he knows it. These people expect the taxpayers to support them.

Let’s face it – developers bring people to our town, they use our neighborhoods – our town! –  to attract buyers, they should have to invest money into our neighborhoods.  We existing residents already pay for that service, it’s called “property taxes.” Our prop taxes are split 45 – 55 by the county and city,  the city of Chico gets roughly half our property taxes. What they do with it? Cause they sure as hell have not been spending my property taxes on my street.

So we’ve got developers paying fees, and residents paying property taxes – why do our streets look like this?

The entire street is becoming broken up and the asphalt has separated from the ground – you can hear it rumbling under your tires like old pottery as you pass over.

In Chico, as all of California, the government has been pouring the gas tax and other revenues that were supposed to be used to fix streets and roads into their pensions. At last Wednesday’s meeting, City of Chico finance mangler Scott Dowell said 15 percent of the “street and urbanization fees” collected from developers goes to “indirect costs” which he identified as “CalPERS.”  At the mention of CalPERS there were audible groans around the room, including committee members and $taff. Nobody wants to talk about CalPERS costs down there.

Sean Morgan complained the explanation “didn’t help.”  

City works employee Brendan Ottoboni said that if developers weren’t willing – in fact, I believe they have been threatening a lawsuit, given the little remarks made about letters being sent and meetings being had – Ottoboni says existing streets that are not “feeders” or do not have new projects built on them will be taken off the projects list.  Staffer Steve said they are still working with a list of projects identified in 2009, but never funded. A specific section of Rio Lindo, which Sean Morgan opined is “one of the worst streets in town,” has been removed from the list.

At this point local builder Bill Webb asked a pertinent question – “how do I get my street on the projects list…” Staffer Steve said, “of 14 projects identified in 2009 as FUNDED, 9 have been taken off the list…” for lack of funding.  “We’ve had a lot of requests for projects…” but the city only fixes streets “where there will be problems due to higher traffic” generated by new subdivisions. 

So here we are on my street, where the “current level of service” is, as one woman sitting near me described, “just crap.” My street is a very heavily used through street, new houses have been built every few lots over the last 20 years, and here’s the level of service we get from the city of Chico.

Every now and then a crew comes through and fills potholes with “slobbers” – asphalt left over from jobs in newer neighborhoods. We got that from the guy who was running the crew one day.

Here’s what a patch job like that looks like within a week.

The meeting ended with arguing, it was hard to hear what motion was made and passed. I believe they voted unanimously to “send the urbanization fees to council as described…” Chris Giampoli asked Brendan Ottoboni what would happen if the “urbanization fee” wasn’t approved by council, and Ottoboni answered “our road maintenance will continue to be unfunded.” He added, “new development…new growth…they use existing roads too…they don’t pay for them currently…”

To which Giampoli responded nastily, “people will continue to complain.” I’m not sure which people he’s talking about, but I’m feeling the beginnings of another lawsuit from the development community, one way or the other. We’ll see.  Years ago, Bill Webb’s dad and uncle and a few other developers sued the city for $500,000 in fees that had not been used for what they’d been collected, and won. 

Mark Sorensen, always politically incorrect, called the discussion a “Mexican stand-off.” So, that’s what we’ve got – a stand-off between the  city and the development community, with the good citizens standing right in the crossfire.

I don’t know anything about this “committee” or how it was established, whether the Brown Act applies or what. I’ll have to snoop into it.

 

 

City of Chico and County of Butte continue to exacerbate the transient problem

My husband likes to get out with our old dog for a quick walk in Bidwell Park before the heat sets in. He took this picture at a campsite off Bryant Avenue this morning.

Yes that is a very well established campsite along Chico Creek. I presume the man is just asleep but if you’d been watching the news lately you might want to poke him with a stick to make sure.

This guy took over a picnic spot that is supposed to be for day use only. 

Look hard – right behind this guy there is a picnic table. And it’s taken him a few days unmolested there to gather all that crap. And I’m not using the word “crap” loosely, I’m guessing there is human waste in the bushes.

Remember the “Occupy Movement”?  Well here it is folks. 

The other day I read about the new “Harm Reduction Center” being opened at Mangrove and First Avenues.

“With the help of Butte County Bar Association, homeless service provider Stairways Programming is opening a harm reduction and legal center this week at 1112 Mangrove Ave. It will provide free legal help and therapy to those who are homeless or living in poverty and struggling with severe mental illness or substance use disorders.

“Attorneys will volunteer their time, offering pro bono work 1-4 p.m. every Monday. During the center’s other hours of operation, 10 a.m.-4 p.m. Monday through Friday, Stairways will provide case management and therapy, and trainings for service providers on methods used at Stairways such as de-escalation, said Stairways Executive Director Michael Madieros.

“’Here’s a chance for them to meet with an attorney, get advice … and start to feel good about the justice system and like somebody cares,” Madieros said. “And when they do show up in court, they feel positive.’”

What I’m hearing is another bum magnet opening up within a mile of one of my rentals, just blocks from the retail centers where I (have done) a lot of my shopping for years. Mangrove shopping center is becoming a bum camp, not to mention that alley that runs  behind Cash and Carry between Palmetto and First Ave. And now this. 

“The new program will also serve as a harm reduction center, operating on a model that Stairways Programming has been using for quite some time. It will provide a space in which those who are experiencing homelessness can learn about and understand the harm they may be creating for themselves and their community by their behaviors, and how they can take small steps to be safer.”

Harm reduction? Stairways has been using this model “for quite some time” ? Well, Mike old buddy, it’s not working.  And here’s why.

“The ultimate goal for those abusing substances is abstinence, Madieros said, but it isn’t the starting point. One of those small steps may be teaching someone how to dispose of needles correctly.

It’s about helping people up, rather than pushing or forcing them, he said.

According to the Oakland and New York-based Harm Reduction Coalition, the philosophy meets drug users where they are, accepting that legal and illegal drug use is part of reality and its effects should be minimized rather than ignored or condemned. The conditions of people’s drug use, such as childhood trauma or mental illness, must be addressed along with the drug use itself, which is where therapy and case management plays its part.”

These people are mollycoddling junkies.  Is it part of reality to allow people to commit crimes to support their drug habit, and for shills like Madeiros to take advantage of the system for their own profit? Yes, Madeiros receives quite a nice salary for “managing” Stairways. Then there’s “CFO” Megan Harriman, another salary.  Stairways receives funding from various public agencies, including Butte County. 

But they still want us to volunteer, not only our time, but money and supplies. 

When this story popped up there was the usual criticism on Disqus, and Madeiros was quick to come back with a response.

“Harm Reduction is the model of treatment. Stairways provides emergency services to anyone in need but our commitment to Chico is we only provide services and programs to people from Chico. This is not a safe space this is a place people can come and start being accountable for their lives and actions.

But when I chimed in to ask about site supervision and for a look at Stairways financial reports, I got no reply. 

I don’t know if they received city money for this enterprise, but I know the city had to permit the use of the building, and I’m wondering if the neighbors were asked for input as is the normal routine. 

I have to laugh – the city refuses marijuana dispensaries, but allows these centers to open all over town without any supervision or input from the neighbors. They wait til problems develop, and then they don’t do anything to fix it.

Camping in Bidwell Park is a crime – report it!

Yesterday, having reported an illegal camp in Middle Bidwell Park to city of Chico officials, my husband and I walked over to the site to find that the campers seemed to be gone but had left mounds of trash behind. In fact, we encountered more trash yesterday than we’d seen the day before.

Here’s the pile we encountered Thursday December 29, still there – notice the dismantled bikes. Somebody had added – a real estate sign? – to the pile.

We noticed new piles, clothes,  trash bags,  kipple of all kinds.

I wonder if they steal from each other, and here’s somebody’s stuff that has been rifled and left.

 

This is located about a block or two from my home, my tenant’s home. We’ve always locked everything up – Chico was never that nice of a town that you could leave your valuables unlocked, that’s been known for some time.  

But lately we’ve been hearing about weird stuff, stuff that goes beyond home security.  One guy was caught stealing a woman’s panties off her back yard clothesline, in broad daylight. Her husband  caught him in the garage, having broken in through a back door to steal a bike.

A man on the  website Nextdoor reported someone had torn the door off a storage shed in his side yard, but said there was nothing of value, so nothing was taken. Lucky him!  I had been bothering my husband to buy one of those metal  sheds at Home Depot for our tenant’s bikes, so she wouldn’t have to keep them in her laundry room. He laughed  and told me, “that’s like telling the transients, ‘look, here’s some stuff for you…'”  He’s right, these people can just rip the door off a shed, hidden in your back  yard, you and  all your neighbors gone off to work. 

As I’ve said, Chico is not a nice little town anymore. How do we fight this? Report it, report it, report it. Demand action.  I’ll e-mail city manager Mark Orme and ask him who is responsible for cleaning up this mess and when that will be done.  I’ll cc both news editors as well as my third district supervisor Maureen Kirk. I may cc the entire council, but Reanette Fillmer is the one who has shown the most interest in this issue.

Please join me in reporting illegal campers. Follow up – if you still see the problem the next day, politely ask what has been done or why nothing has been done. Don’t be intimidated by their polite refusal to do anything – send your e-mail conversation  here, and I’ll print it verbatim.

Chris Constantin is such a considerate fellow. He sent me a note the other day (Sunday!) to tell me, there’d been some changes Downtown, and he wanted to be sure I knew who to direct my questions to in the future. Seems he’s been promoted to Assistant City Mangler, and Frank Fields has been moved up to Administrative Services Mis-Director. Scott Dowell, who ran CARD into the ground as chief finangling officer there, will be sidling into Frank Fields’ position.

And you all heard, we have two new councilors, yippee doo-dah.  I’m going to throw out a no-brainer – Mark Sorensen will be our new Mayor, and Sean Morgan will bask in the glory of Vice Mayor – go get ’em Big Boy!

This will be a short hayride for both of them – Ann Schwab and Mary Flynn will get a big laugh when they ride us right into bankruptcy. I know, I’ve been hard on Mary – I hope she learns to laugh again, and not like a crazy lady.

At this time of year, with darkness and my PG&E bill closing in on me, with no hope of jobs here for my kids, looking at higher and higher prices at the grocery stores despite the recent downturn in gas prices – it’s hard for me to muster a “fuck you” about what’s going on Downtown. Especially when I look at tonight’s agenda

and see nothing but trouble – grants for salaries, fund transfers, unsustainable raises for management and police.

That’s Trouble, right here in River City. Trouble! And that starts with ‘T’ and that’s rhymes with ‘C’ and that’s your City Council.

Chico Tea Party meeting Tuesday 4/22/14 @ 7pm.

The Chico Tea Party Patriots will be holding a symposium. The topic will be the city of Chico’s role in economic development and how Chico can grow its way out of debt.  Mark Orme assistant city manager along with Sean Morgan and Mark Sorensen will be guest speakers.
